Now, let’s take a look at what some of the above-listed matters can entail.

Divorce

Generally, in a Colorado divorce, the court must make determinations on the following:

  • How to divide marital assets between the spouses;
  • How to allocate parental responsibilities (i.e., physical custody, parenting time, and decision-making rights) between spouses who share minor children;
  • Who will be responsible for paying child support for minor children of the marriage and what that amount will be;
  • Whether either spouse is entitled to spousal maintenance; and
  • The amount of the spousal maintenance payments, if any.

Divorce can alter every aspect of your life, so having a skilled and knowledgeable attorney is crucial to protecting your well-being in a divorce case.

Child Custody

Under Colorado family law, an order concerning child custody is called an allocation of parental responsibilities. As stated above, parental responsibilities include parenting time rights, decision-making rights, and physical custody rights for each parent.

In many cases, family law courts order that parents share parental responsibilities. However, one parent might receive more rights than the other if the facts of their case warrant granting one parent significantly greater rights. Judges allocate parental responsibilities according to what is in the best interests of the child, and judges decide the best interests of the child by considering the following:

  • The relationship the child has with their parents, family members, and other significant figures in their life;
  • The child’s wishes;
  • Any history of domestic violence committed by any of the parties involved;
  • How the child has adjusted to their community, school, and home;
  • Each parent’s ability to put the child’s needs before their own;
  • Each parent’s ability to encourage a relationship between the child and the other parent (if appropriate);
  • The physical proximity of the parents to each other; and
  • The health of each parent and the child.

In order to assert your custody rights, you may need to produce evidence related to these factors.  We can help gather the pieces of evidence you need in your custody case to present to the judge in the light most favorable to you. This might also necessitate getting a child custody expert involved.

Child Support

Typically, child custody orders come hand-in-hand with child support orders. Whether you are breaking up with the other parent of your child or were never in a relationship with the other parent, the family court can help ensure that your child has adequate financial support. A parent’s obligation to pay child support and the amount they must pay primarily depends on each parent’s income or earning potential, the child’s financial needs, and the amount of parenting time each parent has.

Alimony

Also known as spousal maintenance, alimony is not mandatory in Colorado divorce cases. A spouse must request support. And if a judge decides that a requesting spouse made significant contributions to their marriage or would be at a financial disadvantage after their divorce, it may award spousal maintenance. These maintenance payments may last anywhere from a few months to a lifetime. We can ensure that the court makes support determinations that are reasonable and fair to you.

Modification of Orders

Relationships can change, children can change, and family court orders can change. You can modify a family court order to do any of the following:

If you want to modify a family court order, you typically must file a motion with the court.  That motion will be resolved by either coming to an agreement with the other party to your case or attending a court hearing where you present your evidence and arguments. Whatever changes you need or want to make, our Greenwood Village family law lawyers can represent you.
