We Can Protect Your Parenting Time and Rights During a Divorce
We know that one of the most important rights to protect in a divorce is your right to spend time with your children. Children can be susceptible to the stress and chaos that can occur between a divorcing couple. Our attorneys always have the best interest of the children in mind when working on your case.
We are experienced in handling all aspects of parenting time. Colorado uses the term “parenting time” in place of custody and visitation, but the meaning is the same. We can craft strategies and parenting time agreements tailored to your family’s needs. But we won’t stop there. We understand that circumstances change over time and modifications need to be made. As your child ages and your job or residence changes, we will support you in making the necessary changes to the agreements and court orders. While we aim to put long-term solutions in place at the start, our Castle Rock divorce attorneys will be there for you along the way.
As part of Douglas County, Castle Rock shares similar family and socio-economic traits with the rest of the county. Thus, our lawyers maintain a high level of legal knowledge related to complex custody matters. This includes staying abreast of changing trends in custody laws and working with custody experts, such as Child and Family Investigators or Parental Responsibilities Evaluators. We understand nothing matters more than the well-being of your children now and in the years to come.
Protecting Your Property Rights
Another important aspect of your divorce is your right to property or marital assets. Our Castle Rock divorce lawyers are here to help fight for your rights to these assets. In some cases, we can work with the spouses to agree on what property will be split between them and how. If the couple cannot reach an agreement, the court may need to be involved to help settle the division of assets.
Colorado is an equitable distribution state. This means that assets and property will be divided “fairly” based on a series of factors. Fair doesn’t always mean equal. Property will not necessarily be split equally or evenly between the parties. Some factors the court considers when fairly dividing property include:
- The length of the marriage,
- The contribution of each spouse to the marriage and acquisition of marital property (including the contributions of raising children and homemaking),
- The economic circumstances of each spouse at the time of the division of property,
- The value of each spouse’s separate property,
- Any increases or decreases in the value of the separate property of the spouses,
- Any depletion of the separate property for marital purposes,
- Each spouse’s earning capacity, and
- The standard of living of each spouse.
The court will primarily be focused on dividing “marital property.” Marital property includes assets and debts acquired during the marriage. Some types of property will be considered separate property. Specifically, the court won’t consider gifts or inheritances or property either spouse acquired after separation. Separate property may also include assets and debts covered by pre-nuptial, post-nuptial, or other marital agreements.
Our attorneys can evaluate your specific circumstances and fight for a fair property division. We can also represent you during any related hearings, trials, or negotiations.

Castle Rock Divorce Attorney FAQs
How Do I File for Divorce in Castle Rock, Colorado?
In Colorado, a divorce is referred to as a “dissolution of marriage.” To start the process of divorce in Castle Rock, you or your spouse must complete the necessary paperwork. Filing for divorce means you complete a petition for dissolution of marriage. This form can be filled out by one or both spouses. Whoever completes the form is the petitioner. If you both complete the form together, one spouse is the petitioner and the other is the co-petitioner.
The dissolution of marriage form requires you to provide information about both spouses, residency, children (if any), any other pending court cases, and the status of the marriage. Colorado is a no-fault divorce state. There is no requirement to prove that either spouse did something wrong to lead to divorce. The parties must state that the marriage is “irretrievably broken” without any chance of reconciliation.
If you are filing individually, you must also serve the other spouse with the petition. Serving your spouse means delivering a copy of the petition to the other spouse. The court will then know that the other spouse has received a copy and is aware of the divorce initiation. You can use a sheriff to deliver a copy of the papers to your spouse and request verification of delivery. If you are co-petitioners, there is no need to serve a copy of the petition.
Once the initial paperwork is done, you will need to disclose certain financial information. Then the process will include court dates, negotiations, and agreements. While it is possible to file for divorce on your own, it is recommended that you hire an experienced Castle Rock divorce attorney. Given the many legal nuances involved, you will be well-served by having the support of a knowledgeable divorce lawyer who will continuously advocate for your interests.
How Long Do I Have to Live in Castle Rock Before I Can File for Divorce?
Before you can file for divorce in Colorado, you OR your spouse must be domiciled in the state of Colorado for a minimum of 91 days. Domicile means the person has the present intent that Colorado is their permanent residence. Some factors to determine a person’s intent to remain permanently in Colorado include: voter registration, vehicle registration, driver’s license, owning property in Colorado, or state tax filings.
