The Process of Dissolving a Marriage
In order for a Jefferson County court to have jurisdiction over your case, either you or your spouse must be a current resident of Jefferson County. Additionally, for divorce involving children (or custody cases), your children must have lived in Colorado for at least six months (182 days) prior to filing a divorce petition (or since birth if a child is under six months of age). This requirement must be met in order for matters involving child custody to be heard by the family law court. Our lawyers can guide Jefferson County residents through each step of this process.
Beyond the initial filing, the first interaction with the court will be an initial status conference, which will be held within 42 days of filing a petition for divorce or custody. Before this status conference, you and your spouse will need to exchange sworn financial statements and other financial disclosures. Though the initial conference is not a traditional court hearing, you and a family attorney should be prepared to discuss the relevant issues in your case. This will include both property issues, such as asset division and support, as well as child-related issues, if there are children involved.
When children are involved, parents are required to try to resolve parenting issues, such as who will have decision-making responsibilities and how much time a child will spend with each parent. Based on what agreement the spouses reach as to parenting time, child support can be calculated and submitted to the court for approval. However, when any of these issues are contested, and an agreement cannot be reached, the court will hold a trial to resolve those issues that are still in dispute. Before permanent orders are entered, all parents will be be required to attend a one-time parenting class.
